Amerigo Auto Transport Terms and Conditions
Effective Date: June 25, 2026
These Terms & Conditions (“Agreement”) govern your use of Amerigo Auto Transport’s website, communications, and transportation brokerage services. By requesting a quote, booking transportation, communicating with Amerigo Auto Transport, providing payment, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Please also review our Privacy Policy, which explains how we collect, use, and protect your information.
1. Company Information
Amerigo Auto Transport (“Amerigo,” “we,” “our,” or “us”) is a federally licensed transportation broker. We arrange the transportation of vehicles through independent, licensed, and insured motor carriers. Amerigo Auto Transport does not own or operate the trucks used to transport vehicles.
2. Transportation Brokerage Services
Amerigo Auto Transport agrees to use commercially reasonable efforts to locate a qualified carrier to transport your vehicle.
Pickup and delivery dates are estimates only unless expressly guaranteed in writing. Transportation schedules may be affected by weather, traffic, road conditions, DOT inspections, mechanical failures, equipment availability, carrier scheduling, acts of God, or other circumstances beyond the reasonable control of Amerigo Auto Transport or the transporting carrier.
3. Customer Responsibilities
Customers agree to provide complete and accurate information regarding:
- Vehicle year, make, and model
- Vehicle condition
- Whether the vehicle runs and drives
- Vehicle modifications or oversized dimensions
- Pickup and delivery locations
- Contact information
- Special loading instructions
Customers agree that either they or an authorized representative will be available during pickup and delivery.
Failure to provide accurate information may result in delays, additional charges, or cancellation of transportation services.
4. Vehicle Preparation
Prior to pickup, customers should:
- Remove all valuables.
- Secure loose accessories.
- Leave approximately one-quarter tank of fuel.
- Ensure the battery is functional.
- Ensure tires are properly inflated.
- Disclose any mechanical issues.
- Provide all necessary keys.
Unless otherwise approved by the transporting carrier, personal belongings should not exceed approximately 100 pounds and should remain below the window line.
Amerigo Auto Transport is not responsible for loss of or damage to personal property left inside the vehicle.
5. Payments
Customers agree to pay all brokerage fees and transportation charges associated with the shipment.
Payment terms will be disclosed at the time of booking.
Failure to make required payments may delay or prevent transportation services.
6. Carrier Assignment
Once Amerigo Auto Transport secures a licensed and insured carrier that accepts your shipment, Amerigo Auto Transport has completed its contracted brokerage services.
At that time, the brokerage fee is considered fully earned.
7. Cancellation & Refund Policy
Customers may cancel transportation before a carrier has been assigned.
Once a carrier has accepted and been assigned to the shipment, Amerigo Auto Transport has fully performed its brokerage services.
Accordingly, brokerage fees become fully earned and are non-refundable after carrier assignment.
Refunds after carrier assignment will only be considered in extraordinary circumstances, as determined solely by Amerigo Auto Transport in its reasonable discretion.
8. Customer Misconduct
Amerigo Auto Transport reserves the right to suspend or terminate services without refund if a customer:
- Provides false or misleading information.
- Misrepresents the vehicle’s condition or dimensions.
- Refuses to cooperate with the assigned carrier.
- Fails to make the vehicle available for pickup.
- Engages in abusive, threatening, fraudulent, or harassing behavior toward Amerigo Auto Transport employees, representatives, or carriers.
- Otherwise materially breaches these Terms & Conditions.
Customers remain responsible for any brokerage fees earned and any costs incurred as a result of their actions.
9. Chargebacks
By submitting payment, the customer acknowledges that payment was authorized for transportation brokerage services.
Customers agree to contact Amerigo Auto Transport and make a good-faith effort to resolve any billing concerns before initiating a chargeback or payment dispute.
If a carrier has been assigned, Amerigo Auto Transport’s brokerage services have been performed and the brokerage fee is considered earned.
Initiating a chargeback for services that have been properly authorized and performed may constitute a breach of this Agreement.
Amerigo Auto Transport reserves the right to provide signed agreements, dispatch records, carrier acceptance records, invoices, payment records, emails, text messages, call recordings, and other business records to contest any improper chargeback or payment dispute.
If Amerigo Auto Transport prevails in a chargeback or legal proceeding arising from an improper payment dispute, the customer agrees to remain responsible for all unpaid balances, collection costs, court costs, reasonable attorney’s fees where permitted by law, and payment processor fees incurred by Amerigo Auto Transport.
10. Vehicle Inspection
Customers or their representatives are responsible for inspecting the vehicle with the transporting carrier at both pickup and delivery.
Visible damage should be documented on the Bill of Lading before it is signed.
Failure to note visible damage at delivery may affect the customer’s ability to pursue a damage claim with the transporting carrier.
11. Carrier Insurance
All damage claims arising during transportation must be submitted directly to the transporting carrier.
Amerigo Auto Transport is not the cargo insurer but will reasonably assist customers by providing carrier insurance information when requested.
12. Limitation of Liability
Amerigo Auto Transport acts solely as a transportation broker.
Amerigo Auto Transport shall not be responsible for delays, losses, or damages caused by weather, traffic, mechanical failures, road closures, carrier scheduling, government action, labor shortages, natural disasters, or other circumstances beyond its reasonable control.
Amerigo Auto Transport shall not be liable for indirect, incidental, special, or consequential damages arising from transportation services.
